General terms and conditions of business of City Apartments Rostock

 

Preliminary Note
City Apartments Rostock rents out fully equipped apartments for guest accommodation purposes.

1. Rental Period
City Apartments Rostock rents out apartments exclusively on a weekly or monthly basis.

2. Prices
All prices are quoted in euros, plus applicable VAT rates. All utility costs—such as electricity, water, and heating—are included in the rental price.
Any additional fees required by law that are to be charged separately to the guest will be listed individually.

3. Booking / Conclusion of Contract
Bookings can only be made via email.
A booking must include an email address to which a booking confirmation can be sent. The contract is deemed concluded once City Apartments Rostock has confirmed the booking in writing via email. The guest has no right to an extension of their stay.

4. Payment
Apartment rent is due no later than the first day of the booking period (and prior to the handover of the apartment) for the current month, and subsequently on the 1st of each following month.
A security deposit is required upon renting the apartment; the amount depends on the duration of the rental.
Rent may be paid in advance via bank transfer (against an invoice), or in cash or by debit card upon handover of the keys.

5. Handover of Keys
The key is handed over to the tenant on the first day of the booking period, and the handover is acknowledged via a written record.

6. Cancellation
Upon conclusion of the contract, City Apartments Rostock reserves the booked apartment for the customer for the booked period.
Up to 28 days prior to arrival, the apartment booking may be cancelled free of charge by either party upon written notice. In the event of a late cancellation, the following fees will be charged:
from 27 to 8 days prior to arrival: 30% of the agreed rental price
from 7 days prior to arrival up to the day before arrival: 60% of the agreed rental price
If the tenant fails to arrive on the scheduled date without prior written cancellation, the booked apartment may be re-let.
In this case, the full agreed rental price is payable.

7. Arrival and Departure
Upon concluding the rental agreement, the guest shall arrange a time with City Apartments Rostock for the handover of the apartment. Upon arrival, the guest is required to present a valid identity card or passport to the authorized representative of City Apartments Rostock.
Check-in and check-out times are between 9:00 a.m. and 6:00 p.m. on the respective days of arrival and departure. The guest may make individual arrangements with City Apartments Rostock for times outside this range.

8. Re-letting / Subletting
The apartment may not be re-let or sublet to third parties. Allowing third parties to use the apartment is expressly prohibited.
In the event of a violation of this provision, the landlord is entitled to terminate the contract for cause with immediate effect.

9. Access
The guest is required to grant access to the apartment to authorized representatives of City Apartments Rostock or to service personnel commissioned by them for the purpose of inspections or repairs.
In emergencies—particularly for the execution of repairs and cleaning work—City Apartments Rostock is entitled to enter the apartment without prior notice.

10. Liability
City Apartments Rostock assumes no liability for the guest's valuables.
City Apartments Rostock is likewise not liable for the theft of or damage to the guest's property, including vehicles parked in the associated parking space.
The guest is liable for all damage to and impairment of the rented premises and furnishings, insofar as such damage exceeds normal wear and tear resulting from proper use.
This also applies to damage and impairment caused by third parties present in the apartment with the guest's consent.
In the event of the loss of one or more keys, the guest must compensate City Apartments Rostock for the cost of replacement or the installation of new locks.

11. Pets
Keeping animals in the apartment is not permitted.

12. Termination of Accommodation
The guest is required to vacate the apartment and return it to City Apartments Rostock no later than 12:00 noon on the day the contractual rental period ends.
Any deviation from this time must be agreed upon no later than the day of arrival.
In the event of extraordinary termination by City Apartments Rostock, the guest is required to vacate the apartment immediately.

13. Place of Jurisdiction / Place of Performance
The place of performance for services is Rostock.
The place of jurisdiction is Rostock for commercial parties, persons with no general place of jurisdiction within the country, persons who have relocated their domicile or habitual residence abroad after the conclusion of the contract, or persons whose domicile or habitual residence is unknown at the time the action is filed.

14. Severability Clause
Should any provision of this contract be invalid, the validity of the remaining provisions shall not be affected. The parties undertake to replace an invalid provision with a valid provision that comes as close as possible to the intended purpose of the invalid provision.
